Samsung's No Union Policy Faces Challenge in China

Samsung's"no labor union"management is facing a grave challenge in China. China’s state-controlled labor union, the All China Federation of Trade Unions (ACFTU), officially expressed its position Friday to bring lawsuits against those foreign corporations that continue to refuse to allow trade unions to set up in their Chinese businesses. Among the lawsuit targets mentioned by the ACFTU were subsidiaries of Samsung.

A high-ranking ACFTU official said,“Together with regional governments, we plan to write up a blacklist of foreign companies that refuse the establishment of trade unions...Those companies that refuse to allow trade unions to establish will one day face lawsuits.”

The ACFTU said it conducted a first round of investigations, along with the National People's Congress, and enumerated eight Samsung subsidiaries -- including Samsung Electronics/Samsung SDI in Tianjin -- as well as Wal-Mart, Dell, Kodak, McDonalds and KFC as representative foreign companies that refuse to allow unions to set up shop in their Chinese businesses. An official with Samsung’s Chinese headquarters said,“Samsung’s Chinese production corporations operate labor-management negotiating councils rather than trade unions. We’ve never been told by either the central or regional government that we had to allow the establishment of trade unions.”

The ACFTU claims, however, that to ignore demands by higher-level labor organizations to allow branches to be set up or to refuse propagation activities related to setting up trade unions were clear violations of Chinese labor union laws.
